01 Who is responsible

Upsofte, a software development agency based in Valencia, Venezuela, is responsible for the processing of data collected through upsofte.com.

02 What data we collect

Only two kinds, and none of it is obtained from third parties:

• What you give us: when you submit the contact form we collect your name, your email address, your company name if you provide it, and the message you write.
• What is recorded automatically: alongside the message we store the IP address it was sent from, the browser used, the page it was sent from and the date. The web server also keeps a standard technical log with the IP address, the page requested and the date of each visit.

03 What we use it for

Contact form data is used solely to reply to your enquiry and to follow up on any commercial conversation arising from it.

We do not use it to send unsolicited marketing, we do not share or sell it to third parties, and we do not use it for profiling or automated decision-making.

Technical server log data is used to keep the site running, diagnose errors and detect abuse, such as automated bulk submissions.

04 Cookies and analytics

This site sets no cookies. It also uses no analytics tools, tracking pixels, advertising or embedded social media.

That means we do not track you across pages or sessions, and we do not share your browsing behaviour with anyone.

05 Third parties involved

There are two, and you should know about them:

• Google Fonts: the site’s typefaces are loaded from Google’s servers. This means that when you visit the page, your IP address reaches Google, which handles it under its own privacy policy.
• Hosting provider: the site and the contact form messages are stored on a server contracted with InterServer, located in Secaucus, New Jersey, United States. This means your data is stored outside Venezuela.

06 Where it is stored and for how long

Contact form messages are stored in a server file that is not reachable from the web, and a copy is also sent by email to an internal Upsofte address.

We keep messages for as long as there is a commercial relationship or a legitimate interest in following up, and at most for two years from the last contact, unless the law requires us to keep them longer. Technical server logs are rotated periodically and kept for a few weeks.

07 WhatsApp

The buttons on this site open a WhatsApp conversation with us. If you choose to write to us through that channel, the content of the conversation is also governed by the privacy policy of WhatsApp and Meta, which we do not control.

08 Your rights

You can ask us at any time to tell you what data of yours we hold, to correct it if it is wrong, or to delete it.

To exercise any of these rights, write to us on WhatsApp or through the contact form stating what you need. We reply within thirty days at most, at no cost to you.

09 Security

The site is served entirely over an encrypted connection (HTTPS). Contact form messages are stored outside the server’s public directory with restricted permissions, and the form applies submission limits to curb automated use.

No measure is infallible. Should a breach affecting your data occur, we would inform you.

10 Changes to this policy

If we change how we handle data — for example, if we add analytics in the future — we will update this page and the last-updated date shown above.
